In a recent decision, the United States Court of Appeals for the Eighth Circuit approved an employer’s practice of requiring truck drivers with Body Mass Indexes (BMIs) of 35 or greater to get medical examinations to determine whether they had obstructive sleep apnea. It rejected a driver’s claim that the required examination violated the Americans with Disabilities Act (ADA). While it is possible that other courts outside the geographical coverage of the Eighth Circuit will not follow this decision, this case provides employers with a road map for addressing potential sleep apnea issues.
